Terms of Service

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply. These Terms constitute a legally binding agreement between you and the applicable Alternaly entity (Alternaly Inc. or Alternaly LLC) based on your location and the services you use.

• Loan Calculator: A free tool for calculating loan payments, amortization schedules, and APR. This tool is for informational purposes only and does not constitute a loan offer or financial advice.
• Private Lending Platform: Connecting borrowers with private lenders for mortgage financing.
• Loan Management: Tools for lenders to manage loan portfolios, collect payments, and track performance.
• Broker Services: Platform for mortgage brokers to submit deals and track commissions.
• Document Generation: Automated creation of loan documents compliant with applicable regulations.
• Payment Processing: Pre-authorized debit (PAD) collection for loan payments.

• General Account: You may create an account at any age to explore our platform features and use the calculator.
• Loan Applications: You must be at least 18 years of age and legally capable of entering into binding contracts in Quebec to apply for a loan.
• Lender Accounts: You must be at least 18 years of age and comply with all applicable lending regulations.
• You represent that all information you provide is accurate and complete.

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• You may not share your account with others or create multiple accounts.

• Pay As You Go Plan: $5/month per active loan (up to 9 loans) with access to core features.
• Unlimited Plan: $50/month for unlimited loans, team members, API access, and white-label options.
• Managed Plan: 1.5% of capital for fully managed lending services.
• Transaction Fees: Pre-authorized debit fees and NSF fees as specified in our pricing.
• Subscriptions are billed monthly and can be cancelled at any time.
• Refunds are not provided for partial months of service.

You retain ownership of all data and content you create or upload to our platform. This includes loan details, documents, and any other information you provide. By using our services, you grant Alternaly a limited license to use, store, and process your content solely for the purpose of providing our services to you. We will not use your content for any other purpose without your explicit consent.

• Using the platform for any illegal purpose or in violation of any laws.
• Providing false or misleading information.
• Attempting to circumvent security measures or gain unauthorized access.
• Using the platform to harass, abuse, or harm others.
• Interfering with the proper operation of the platform.
• Using automated systems to access the platform without permission.
• Engaging in money laundering or fraudulent activities.
• Violating any applicable financial regulations.

The Alternaly platform, including its design, features, content, and underlying technology, is owned by Alternaly Inc. and its affiliated entities and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without our written permission. The Alternaly name, logo, and branding are trademarks of Alternaly Inc.

• INFORMATIONAL PURPOSES: The loan calculator and other tools are provided for informational purposes only. Results are estimates and may not reflect actual loan terms.
• NOT FINANCIAL ADVICE: Our platform does not provide financial, legal, or investment advice. Consult with qualified professionals before making financial decisions.
• NO GUARANTEE: We do not guarantee loan approval, specific interest rates, or funding timelines.
• AS-IS BASIS: The platform is provided "as is" without warranties of any kind, express or implied.
• We are not responsible for decisions you make based on information from our platform.

To the maximum extent permitted by law, Alternaly Inc., Alternaly LLC, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Alternaly Inc., Alternaly LLC, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our discretion with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the platform shall be resolved exclusively in the courts of the judicial district of Terrebonne, Quebec, and you consent to the personal jurisdiction of such courts.

We may modify these Terms at any time by posting the revised terms on our platform. We will provide notice of material changes via email or platform notification at least 30 days before they take effect. Your continued use of the platform after changes become effective constitutes acceptance of the modified Terms.
